Scranton woman allowed to curse at toilet

A woman who was cited for disorderly conduct for loudly cursing at her overflowing toilet — and then at an off-duty police officer who told her to keep it down — has been acquitted.

District Judge Terrence Gallagher dismissed the charge against Dawn Herb, 33, of Scranton, ruling that she was within her First Amendment rights when she let loose a string of profanities on Oct. 11.

Although the language she used “may be considered by some to be offensive, vulgar and imprudent … such representations are protected speech pursuant to the First Amendment,” the judge wrote Thursday.

Herb was cited after her neighbor, city Patrolman Patrick Gilman, called authorities to complain.

The patrolman is an embarrassment to his department. It’s ridiculous to take advantage of a badge and gun to get back at a neighbor for something so trivial. But, as we move into a police state (“10,000 more police needed!” is the perennial cry of those favoring big government), such incidents will become more commonplace.
Thank goodness the judge was a decent person who could stand up for the individual instead of a cop gone wrong.

last holiday my family was having a small get together. my neighbor is a cop. never met him in the last 9mo of living next to him. NE ways, to make a long story short, this officer has never said a word to us, my kids would pick up trash from both neighbors yards, we thought we were at peace. we have private property on our house, fence, etc. anyways, this OFF DUTY officer makes a complaint of noise. At this time, everyone was getting ready to go inside to eat. Kids were washing hands, guys bringing chairs in, BBQ pit turning off, music off, etc. Well, an ON DUTY officer arrives & everything was cool. The cop on duty was real nice. But then the neighbor i guess thought that we werent being handled to HIS standards, came into our yard. My husband told the neighbor to leave our property that we were already talking to an officer on duty. the neighbor & my husband were in front of our kitchen window, the neighbor then grabbed my husband to put his hands behind his back.The officer who was on duty was under the carport watching. The off duty (neighbor) then told the on duty to give him his cuffs to cuff my husband. It was a mess. kids crying, the off duty cop yelled at me in my face, my company, it was ugly! My husband was taken in, & when asked the on duty cop what for, HE didnt even know. Rights werent read, the dummies didnt know how to get us! Stupidity, overusing authority, ignorance, & evil. To this day we are still trying to fight for our rights of this off duty officer actin a fool in OUR yard when another officer had things under control. For threatening my family, yelling at me in my face in front of my kids, for falsly arresting my husband. See, we’re not perfect, & i surely have done crimes in the past when i was a kid AND admitted to it, but this time, I’m glad my kids saw, that even someone who serves a community can step out of bounds. Meaning we ALL can be evil’s puppet, & ANYONE can fall into the other side of the law. To those who have been done wrong by officers & so forth, dont be afraid to fight for your rights. Dont let people demolish your intelligence just cause you have tattoos, or a bad past. WE ALL HAVE RIGHTS. It’s all good though, in the end, God’s vengeance is more powerful than what the government’s is. N-E Ways, thanks for your time & May God Bless.
