PA House votes to limit use of independent contractors

Employers in the construction industry who cut costs by misclassifying workers as independent contractors would face criminal penalties under a bill approved Monday by the Pennsylvania House of Representatives.

The Construction Industry Independent Contractor Act passed 122-76 despite opposition from lawmakers who argued that its penalties were too severe and that it would hurt the state’s economy.

“I can’t believe that we want to create an environment where we make Pennsylvania business people who try to legitimately follow the rules that aren’t real clear … criminals,” said Rep. Scott Boyd, R-Lancaster.>

Supporters said the practice is unfair to competitors, deprives the state unemployment and worker’s compensation funds of income and shortchanges workers in pay and benefits.

Contractor fraud, primarly

Contractor fraud, primarly classified as theft by deception, is a large problem in the growing areas of the state, specifically NEPA counties of Monoroe, Pike, and Wayne.

The individuals who perpatrate this crime seek out new residents claiming to be a knowledgeable contractor, then proceed to begin a job with no intention of finishing it. Once a small portion of work is done, the criminal often requests additional funds for supplies from the homeowner. Once they receive the additional money the criminal is never heard from again, as they are not required to register their address with the Commonwealth.

Pennsylvania law relating to contractor theft is severly deficient, and invites this kind of activity. Even if an unscrupulous contractor is caught under the “theft by deception” tag, he/she is likely to already be in bankrupcty court, which prevents the homeowner from ever recoping their funds. Bottomline, this is a necessary piece of legislation that other states have successfully implemented.

"Independent Contractor" Practice: A Scam

This practice is nothing more than a scheme for rapacious employers to avoid payment of unemployment and worker’s compensation taxes, leavng their hapless workers and/or their families without any means to a livelihood in the event of injury or death on the job. The enactment of the “Construction Industry Independent Contractor Act” will put these predators where they belong…in front of a magistrate charged with a criminal act.
Any member of the General Assembly who votes to allow this third-world practice to continue in Pennsylvania is as unconscionable as are these same predators.

Let me get this straight… the offer is out there for a job. The independent contractor comes along and takes the job. Now, everyone wants to complain the company is mistreating the worker. But who came along and took the job in the first place? Prob the very same person complaining.

Kudos to Deweese? Really? This is the same guy that said he knew nothing about the bonuses for campaign work that he – himself – signed? Ok there PD… give out your kudos.

He's the majority leader

DeWeese is the majority leader. Without his support, a good bill such as this would never even see the light of day on the floor. So, yes, he deserves credit for its passage.

Did you read what I wrote? No, DeWeese doesn’t deserve all the credit, but he does deserve credit. The fact is, even with the new rules, the majority leader can block bills from getting to the floor. It’s to DeWeese’s credit that he supported and moved this bill to passage.

Perhaps you should get over your own hangup about the guy.

Those that defend business at any cost to the worker must have been at the beach house when this went through.
